Terms & Conditions

• 'Funky Fresh, LLC' and the Customer hereby agree to the following terms and conditions with respect to the services which are identified and/or described in the service agreement attached to these terms and conditions.


• The Customer will be provided with Logo Design Service according to the Package chosen by the Customer. 3 initial designs will be created iteratively through a Design process of Creative Briefing-Basic Concepts-Feedback-Revision Stage, ultimately resulting in 1 final Design conforming to Customer's Creative Briefing and Feedbacks.


• Creative Briefing and Designs. The Customer is solely responsible for preparing and sending detailed answers to our logo's specification briefing ("Creative Briefing, through the Order Form"). 'Funky Fresh, LLC' is under no obligation to review a Creative Briefing for further Feedbacks for any purpose, including accuracy, completeness of information, quality or clarity. 'Funky Fresh, LLC' may decide, in its sole discretion, to deny a Creative or Revision Briefing or Feedback.


• When 'Funky Fresh, LLC' provides the 3 Designs to the Customer, the Customer shall review and choose 1 design to move forward with. If the Customer fails to promptly inform 'Funky Fresh, LLC' that the provided Designs are not reasonably responsive to the provided Feedback, the Customer will be deemed to have accepted the Designs. 


• Revision stage: Revision will consist of 1 additional composition that incorporates a slight font and/or color change requested by the Customer in the Revision Brief. The purpose of the revision process is to create Responses that move forward in a specific direction as determined by the Customer. 


• Project duration: The Customer agrees to provide timely responses to 'Funky Fresh, LLC' after receiving status notifications from 'Funky Fresh, LLC'. The Customer shall have 15 days to respond to each set of designs sent to the Customer for review. If after 15 days the Customer has failed to respond, 'Funky Fresh, LLC' will assume the Project complete and the Project shall be deemed to be complete. At such time, 'Funky Fresh, LLC' shall have no further obligation to the Customer. In rare cases, if the customer feels that it may take him more than 15 days to respond then he is requested to inform 'Funky Fresh, LLC' accordingly, so that 'Funky Fresh, LLC' keeps the project in active state. Project must be completed by April 30, 2011.


• Holiday dates: We work 8am until 5pm between Monday and Friday. We remain closed on Saturdays and Sundays. During the following dates service will not be available: 12/24; 12/25; 12/31; 01/01. 


• Eligibility Requirements: The Customer must be at least 18 years of age and agree to these Terms and Conditions. By asking for our services, you represent and warrant that you meet these eligibility requirements, that the information you include as part of the ordering process is complete and accurate and, if you are ordering services on behalf of an entity, that you are authorized to bind that entity to these Terms and Conditions.


• Deliverables: Deliverables will include a CD of digital files that can be used in various formats and applications. 


• Disputes: Funky Fresh, LLC is not responsible for any/all disputes that may/may not arise from logo usage.


• Usage rights: Funky Fresh, LLC retails all the rights of all logo concepts presented. The two logos that are not chosen may not be used or borrowed from in any form after initial presentation. Once final concept has been approved and the file has been requested, client reserves the right to coordinate with the proper copyright agencies to transfer the copyrights of the chosen logo to their respective business name and complete the process.
