Estate Planning Package includes a Last Will (with a testamentary trust, if applicable), Living Will and Advanced Health Care Power of Attorney for winner and spouse (if any).
- Includes reciprocal Last Wills for the winner and spouse (if married) and all provisions for their child/children (if any), including guardianship designations and testamentary trust provisions, as well as a Living Will and Advanced Health Care Power of Attorney for winner and spouse (if married)
- Who needs an estate plan? If you don't have an estate plan, upon your death the State of Arizona will decide important decisions for you - such as who gets your assets and who cares for your children. If you don't have a living will or health care power of attorney, very difficult decisions about your end of life care and other important health care decisions will need to be made without your input. An estate plan that includes a Last Will, Living Will and Health Care Power of Attorney provides all of the documentation you need to make sure your wishes will be followed.
- What is a testamentary trust? A testamentary trust allows you to put inheritance in a trust instead of allowing beneficiaries (such as children) to inherit assets directly. This auction includes testamentary trust provisions for your children (if any), so you can decide at what age you want them to inherit your assets. Until your child reaches the age you designate (for example, age 18 or 25 or 35), any inheritance payable to the child will be held in trust and distributed by a trusted advisor (known as a trustee) until the child reaches the age you decide.
- What is a Living Will? A Living Will allows you to make all of your end of life health care decisions, such as whether you want to use life support to prolong your life. A Living Will prevents your loved ones from having to guess what you would have wanted when difficult decisions needs to be made.
- What is a Advanced Health Care Power of Attorney? An Advanced Health Care Power of Attorney allows you to decide who will make health care decisions for you if you become unable to do so.
