Mediation is the use of a neutral third party to facilitate the resolution of a dispute by the parties themselves. The mediator helps the people who have a dispute communicate with each other in a quiet, confidential setting; focus on what their issues are; see what they care about - what their interests are - and then to consider each other's feelings and perceptions, understand one another better, consider possible options for meeting their needs and resolving the dispute by agreement; and also consider what might happen if they do not resolve the dispute - including the costs and risks of going to court, as well as other alternatives and consequences to not reaching a negotiated agreement.
